On October 8, 2024, the German Federal Ministry of the Interior and Community issued an official letter providing important clarification regarding the possibility of changing the residence status for individuals granted temporary protection under §24 of the Residence Act (AufenthG).

The document confirms:

- A safe transition from §24 AufenthG to a residence permit for employment or education purposes (e.g., §18a, §16b AufenthG) is allowed;

- In the event of job loss or termination of studies, it remains possible to return to §24 as long as temporary protection under the EU directive remains valid;

- Entitlement to social benefits continues even during the period covered by a “fictitious certificate” (Fiktionsbescheinigung);

- Foreigners authorities are urged to actively inform affected individuals and apply flexibility when handling such applications.
